(a) Purpose. This part stipulates the regulations on the handling and storage of hazardous substances to protect the public health, safety, welfare and environment of the country. (b) Applicability. This part applies to the facilities described in section 596.1 (b) of this title. (c) Definition. The definitions in section 596.1 (c) of this title apply to this part. (d) Severability. If any provision of this Part or its application to any person or circumstance is deemed invalid, the rest of this Part and its application to other persons or the environment shall not be affected. (e) Differences. (1) At the written request of any person subject to this Part, the Department may approve the difference from one or more specific provisions of this Part. The change request must: (i) determine the specific provisions of this part for which the change is sought; (ii) to demonstrate that compliance with the identified requirements would impose a significant economic, technical or safety burden on that person, based on conditions unique to that person's particular circumstances; And (iii) demonstrate that the proposed activity will not have a material adverse impact on public health, safety, welfare or the environment and will comply with the provisions of ECL and the expected performance of this Part. (2) The Department shall not approve any change that would result in less stringent regulatory controls than those specified in 40 CFR Parts 280 and 281 (see subsection (j) of this section). (3) In approving any variance, the Department may impose specific conditions as necessary to ensure that the activities do not have a material adverse impact on public health, safety, welfare or the environment. (f) Confidentiality. Any person who submits information to the Department pursuant to this part may, at the time of submitting the information, request the Department to exempt such information from disclosure in accordance with section 87 (2), paragraph (d), of the Public Officials Act.
